Construction, Design and Management

The Construction (Design and Management) regulations (CDM) changed in April 2015. Amongst the changes were the inclusion of domestic properties and changes among the duty holders.

Under the CDM 2015 regulations there are six duty holders

Client

 Commercial Clients

Make suitable arrangements for managing their project including:

  • Appointing other duty holders to the project and ensuring they have the competence to undertake the role for which they are assigned.
  • Allow sufficient time and resources for each stage of the project.
  • Make sure the Principal Designer and Principal Contractor carry out their duties in managing the project.
  • Ensure suitable and sufficient welfare facilities are provided on site.
  • Maintain and review the management arrangements for the duration of the project.
  • Provide pre-construction information to all other duty holders as required (including those bidding for the work).
  • Ensure the Principal contractor prepares a construction phase plan.
  • Ensure the Principal Designer prepares a health and safety file.

Domestic Clients

Duties for Domestic Clients are normally transferred to the Contractor (for single contractor projects) or the Principal Contractor (for projects with more than one contractor).

If preferred the Domestic Client can have a written agreement with the Principal Designer to undertake the Client duties.

Designers

 Ensure the Client is aware of their duties under CDM 2015.

  • Wherever possible eliminate foreseeable health and safety risks from the project.
  • Reduce or control risks that cannot be eliminated.
  • Provide design information to the relevant duty holders ass required.
  • Communicate, cooperate and coordinate with the Principal Designer and Principal Contractor.

 

 Principal Designer

 Plan, manage and coordinate the pre-construction phase.

  • Assist the client in the provision of the pre-construction information and provide to the other duty holders.
  • Work with the Designers to, wherever possible, eliminate foreseeable health and safety risks and reduce or control those that cannot.
  • Ensure all duty holders in the pre-construction phase cooperate and communicate, coordinating their work whenever required.
  • Liaise with the Principal Contractor regarding any risks likely to occur in the construction phase.

 

 

 

 

Principal Contractor

  • Plan, manage and coordinate the construction phase.
  • Take into account the health and safety risks to everyone (including members of the public) likely to come into contact with the project.
  • Liaise with the Client and Principal Designer to ensure risks are effectively managed.
  • Prepare a construction phase plan prior to starting work and regularly review it to ensure it remains fit for purpose.
  • Have ongoing arrangements in place in order to manage health and safety during the construction phase.
  • Consult with workers regarding their health, safety and welfare.
  • Ensure suitable and sufficient welfare provisions are in place for the duration of the construction phase.
  • Ensure anyone appointed by them has the competence to undertake the tasks assigned to them without risk to health and safety.
  • Ensure all workers receive a site specific induction and any on-going training required.
  • Secure the site against unauthorised access.
  • Liaise with the Principal Designer regarding any risks relating to the pre-construction phase.

Contractors 

  • Ensure the Client is aware of their duties under CDM 2015.
  • Plan, manage and monitor all works undertaken by themselves and their workers and take into account the health and safety risks to everyone (including members of the public) likely to come into contact with the project.
  • Ensure all workers are competent to undertake the tasks assigned to them.
  • Ensure workers under their control have received a site specific induction.
  • Do not start work until reasonable precautions are in place to prevent unauthorised access.
  • Ensure suitable and sufficient welfare provisions are provided and maintained throughout.
  • Coordinate their works with other members of the project team.
  • Comply with the directions given by the Principal Designer and Principal Contractor.
  • Comply with the relevant parts of the construction phase plan.

Workers

  • Only carry out tasks you are competent to undertake.
  • Make themselves aware of the risks involved in the project and how they are to be managed.
  • Follow site rules and procedures.
  • Cooperate with other duty holders.
  • Report any risks to whoever controls the works on site.
